Privacy Policy



Mortgages Ltd. Securities, L.L.C. recognizes that protecting the privacy and security of the personal information obtained about our borrowers and beneficiaries is an important responsibility. We want you to understand what information we collect and how we use it. In order to provide you with a broad range of financial products and related services as effectively and conveniently as possible, we occasionally provide others with information about you, as detailed herein.

Collection of Investor Information. Mortgages, Ltd. Securities, L.L.C. collects personal information from its investors primarily from the following sources: account applications, subscription agreements, purchaser representative questionnaires, and other documents. Information may also be collected by telephone, electronically, by fax, through personal meetings, and by any other means.

Why We Collect Your Information. We gather information about you and your accounts so we can (i) deliver products and services tailored for your needs, (ii) know who you are and thereby prevent unauthorized access to your information, (iii) design and improve the products we offer, and (iv) comply with laws and regulations that govern us.

Important Information about Procedures for Opening a New Account. To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account.

What this means for you: When you open an account, we will ask for your name, address, date of birth and other information that will allow us to identify you. We may also ask to see your driver´s license or other identifying documents.

Verification of Investor Information. NASD rules requires that each broker/dealer must conduct its own risk-based analysis of the types of documents that it believes will enable it to verify the true identities of customers. Examples of documents that firms may use for verification include:

  • For an individual, an unexpired government-issued identification evidencing nationality or residence and bearing a photograph or similar safeguard, such as a driver's license or passport; and
  • For a person other than an individual (such as a corporation, partnership, or trust), documents showing the existence of the entity, such as certified articles of incorporation, a government-issued business license, a partnership agreement, or a trust instrument. These documents are merely examples of reliable documents. Mortgages Ltd. Securities, L.L.C. may use other documents for verification provided that the documents allow the firm to establish Rev102306 a reasonable belief that it knows the true identity of the investor. Examples of non-documentary methods of verification include:

    • Contacting an investor;
    • Independently verifying the investor's identity through the comparison of information provided by the investor with information obtained from an investor reporting agency, public database, or other source;
    • Checking references with other financial institutions; or
    • Obtaining a financial statement.

Confidentiality and Security. Mortgages Ltd. Securities L.L.C. has always considered the protection of sensitive information to be a sound business practice and a foundation of customer trust. We maintain safeguards that comply with federal standards to protect investor Information. We do not sell or rent investor information. We restrict access to your nonpublic personal information and only allow disclosures to persons and companies as permitted by law to assist in providing products or services to you. We require our employees and all companies to which we disclose your nonpublic personal information to maintain its confidentiality. Access to information is provided only to those employees who need it to perform their job responsibilities. We maintain physical and electronic safeguards to guard your nonpublic personal information.

What Information We Collect. We may collect the following types of "nonpublic personal information" about you:

  • Information about your identity, such as your name, address, Social Security or other tax ID number, nationality, and date of birth;
  • Information about your transactions with our affiliates or with us, such as your account balance, and payment history;
  • Information we receive from you on applications or other account forms, such as your assets, income, and financial / investment qualifications; and
  • As required by the USA PATRIOT Act, we also collect information and take actions necessary to verify your identification.

What Information We Disclose and to Whom We Disclose It. Your nonpublic personal information may be disclosed as follows:

  • We may disclose all of the information that we collect, as described above, to our employees and "affiliates" (i.e., companies related to us by common control or ownership); and Rev102306
  • We may disclose nonpublic personal information about you (i) to companies to assist us in servicing your investment, loan or account with us, which may include attorneys, accountants, auditors and other professionals (ii) to government entities in response to subpoenas or court orders (iii) to protect against fraud, unauthorized transactions (such as money laundering), claims or other liabilities; and (iv) upon consent of an investor to release such information, including authorization to disclose such information to persons acting in a fiduciary or representative capacity on behalf of the investor. We do not disclose any nonpublic personal information about you to any other non-affiliates without your express consent, except as permitted or required by law. You may have other privacy protections under state laws; we will comply with applicable state laws with regard to our information practices.

Your Right to Access Your Personal Information. You have the right to review the personal information that we have on record about you. If you wish to review that information, please contact the Mortgages Ltd. Securities, L.L.C. office where you received this notice and give us a reasonable time to make that information available to you.

Marketing Contacts. From time to time, we may call or write to tell you about financial products or services that we think may be of interest to you.

Former Customers. We will continue to adhere to the privacy policies and practices described in this Privacy Pledge even after your account is closed or becomes inactive. When required, we may disclose nonpublic personal information about a former customer to the same extent as for a current customer.

Amendments. Mortgages Ltd. Securities, L.L.C. may make changes to its privacy policy in the future. We will not make any change affecting you without first sending you a revised privacy policy describing the change

Distribution of Privacy Policy. Regardless of whether any changes are made to the current privacy policy, Mortgages Ltd. Securities, L.L.C. will provide you with a copy of the privacy policy annually.
